Please read these Terms of Service carefully. By downloading, accessing, or using EchoHawk, you agree to be bound by these terms. If you do not agree, do not use our services.

1. Acceptance of Terms

By creating an account or using EchoHawk ("the App", "Service", "we", "us", or "our"), you agree to these Terms of Service and our Privacy Policy. These terms apply to all users of the App.

We may modify these terms at any time. Continued use of the App after changes constitutes acceptance of the modified terms.

2. Description of Service

EchoHawk is a community safety platform that enables users to:

  • Receive real-time alerts about local incidents
  • Report incidents in their area
  • View incident information on an interactive map
  • Engage with community safety information

The Service is provided for informational purposes and should not replace official emergency services.

3. Information Accuracy and User Responsibility

CRITICAL DISCLAIMER - READ CAREFULLY:

3.1 No Guarantee of Accuracy

EchoHawk is NOT responsible for the accuracy, completeness, or reliability of any incident reports or information provided through the Service. Information on the platform comes from multiple sources, including:

  • User-submitted reports (which may be inaccurate, false, or misleading)
  • AI-powered automated discovery systems (which can make errors and misinterpret information)
  • Third-party sources (which may contain errors or outdated information)
  • Community voting and verification (which is subjective and may be incorrect)

3.2 AI-Generated Content Limitations

Our Service uses artificial intelligence (AI) agents to discover and aggregate incident information: CityHawkAI (monitors major cities), HawkAlertAI (scouts global breaking news), and RedAlert AI (monitors your personal areas). AI systems can and do make mistakes. AI-generated content may:

  • Misinterpret news articles or social media posts
  • Incorrectly identify locations, times, or incident details
  • Generate false positives (reporting incidents that didn't occur)
  • Miss actual incidents (false negatives)
  • Combine or confuse multiple separate incidents
  • Contain outdated or superseded information

DO NOT trust AI-generated incident reports as factual without independent verification.

3.3 User Content is Not Verified

We do not verify, validate, or fact-check user-submitted incident reports before they appear on the platform. Users may:

  • Submit false, misleading, or inaccurate information
  • Report incidents that never occurred
  • Provide incorrect locations or times
  • Misidentify incident types or severity
  • Share rumors or unconfirmed information

The community voting system provides subjective feedback but does NOT guarantee accuracy. Even highly-voted incidents may be incorrect.

3.4 Your Responsibility to Verify

YOU ARE SOLELY RESPONSIBLE FOR:

  • Independently verifying ANY information before relying on it
  • Contacting official sources (police, fire department, news media) to confirm incidents
  • Making your own informed decisions about safety and security
  • NOT taking any action based solely on information from EchoHawk
  • Understanding that information may be incomplete, outdated, or entirely false

3.5 No Liability for Errors or Omissions

We expressly disclaim any and all responsibility for:

  • Inaccurate, incomplete, or misleading incident reports
  • Errors in AI-generated content or automated discovery
  • False reports submitted by users
  • Missing or delayed incident information
  • Any decisions, actions, or harm resulting from reliance on information from the Service

EchoHawk makes NO warranties or representations about the accuracy, reliability, completeness, or timeliness of any information on the platform.

3.6 Do Your Own Research

Before taking any action based on incident information:

  • ✓ Verify with official sources (police departments, news outlets, government agencies)
  • ✓ Look for multiple independent confirmations
  • ✓ Check the date and time stamps for currency
  • ✓ Consider the source and reliability of the reporter
  • ✓ Use critical thinking and common sense
  • ✓ Remember that absence of reports does NOT mean an area is safe

EchoHawk is an informational tool only. It is NOT a substitute for official emergency information, law enforcement resources, or professional safety advice.

4. User Accounts

4.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Notify us immediately of unauthorized access
  • Be at least 13 years old (or the minimum age in your jurisdiction)

4.2 Account Responsibility

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these terms.

5. User Content

5.1 Your Content

You retain ownership of content you submit ("User Content"). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with the Service.

5.2 Content Standards

Your User Content must not:

  • Be false, misleading, or inaccurate
  • Violate any law or regulation
  • Infringe on third-party rights
  • Contain harmful, threatening, or harassing content
  • Include personal information of others without consent
  • Contain spam, malware, or malicious code

5.3 Content Moderation

We reserve the right to remove or modify any User Content that violates these terms, without prior notice.

6. Prohibited Activities

You agree NOT to:

  • Submit false incident reports
  • Harass, threaten, or intimidate other users
  • Impersonate any person or entity
  • Use the Service for illegal purposes
  • Interfere with the Service's operation
  • Attempt to gain unauthorized access to any systems
  • Collect user data without authorization
  • Use automated systems to access the Service
  • Circumvent any security measures
  • Encourage or assist others in violating these terms

7. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by EchoHawk and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the Service
  • Reverse engineer or decompile the App
  • Use our trademarks without permission
  • Create derivative works based on the Service

8. Emergency Services Disclaimer

CRITICAL: ALWAYS CALL 911 FOR EMERGENCIES. EchoHawk is NOT a replacement for emergency services. In case of emergency, always call your local emergency number (911 in the US). The information provided in the App may not be accurate, complete, or timely. Do NOT rely on EchoHawk for emergency response.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Accuracy, reliability, or completeness of information
  • Uninterrupted or error-free operation
  • Fitness for a particular purpose
  • Non-infringement of third-party rights

We do not verify, validate, or guarantee the accuracy of ANY incident reports, whether user-submitted or AI-generated. ALL information should be independently verified before relying on it.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHOHAWK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Personal injury or property damage
  • Any damages arising from your use of the Service

Our total liability shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless EchoHawk and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these terms
  • Your violation of any rights of another party
  • Any reliance on information from the Service
  • Any actions taken based on incident reports or AI-generated content

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and data
  • Provisions that should survive termination will remain in effect

You may delete your account at any time through the app settings.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in the applicable jurisdiction.

14. Dispute Resolution

Before initiating any legal proceeding, you agree to first contact us to attempt informal resolution. If we cannot resolve the dispute within 30 days, either party may proceed with formal dispute resolution.

15. Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and EchoHawk regarding the Service.
